Nakawa Chief Magistrates Court has directed Luzira Prison authorities to allow lawyers representing jailed National Unity Platform (NUP) Deputy Spokesperson  Alex Waiswa Mufumbiro, free access to their client whenever he appears in court.

The order was issued by Grade One Magistrate Andrew Katurubuki following complaints by defence lawyer Farouq Sserunkuma, who told court that prison warders have repeatedly blocked the legal team from speaking to Mufumbiro or approaching him during previous court appearances.

Magistrate Katurubuki made the ruling while presiding over the case on behalf of trial Magistrate Frank Namanya who, like State Prosecutor Mahatma Odongo, is currently away on official leave. 

Their absence forced court to adjourn the matter, sending Mufumbiro back to Luzira Prison until  December 17th  2025.

Meanwhile, Mufumbiro’s legal team, accompanied by his brother Kato Kenneth Wilson and campaign agent Eng. Hon. Ronald Nsubuga Balimwezo, renewed their plea for bail, citing the deteriorating health of Mufumbiro’s wife, Edith Mufumbiro, who has been hospitalized with cancer for the past two weeks.

The court did not pronounce itself on the bail request during Tuesday’s session, Mufumbiro, aged 39, faces two criminal charges including incitement to commit an offence under Section 21(1) of the Penal Code Act, has been consistently denied bail by court as his case is of public interest and that investigations were still ongoing.

Prosecution alleges that on September 4th 2025, within Kampala mufumbiro  incited party supporters to commit acts of violence against security personnel, including murder. Mufumbiro has since denied the allegations.

The case is scheduled to return to Nakawa Chief Magistrate’s Court on 17 December 2025 for mention, pending the return of the trial magistrate and prosecutor.

Mufumbiro who is  NUP’s Nakawa East MP aspirant, also faces charges of participating in a  February military parade at NUP headquarters in Kavule for which he was  first remanded by the Kawempe Magistrates Court in September  2025.

He will return before the Kawempe court on Friday this week to recieve a ruling on his application for mandatory release having clocked morethan 60 days on remand without trial.

The other accused in that matter in Kawempe include Edward Ssebuufu (alias Eddie Mutwe), Kivumbi Achileo, Tasi Calvin (alias Bobi Giant), Sserunkuma Edwin (alias Eddy King Kabejja), Lukenge Sharif, Nyanzi Yasin, Kaweesi Tonny, Saudah Madaada, , Kaija Doreen and Olivia Lutaaya. They face multiple charges, including unlawful drilling, conspiracy to commit a felony, and wearing uniforms resembling security forces. 

These charges stem from an incident allegedly held on February 12, 2025, at the NUP offices in Makerere-Kavule, where the accused reportedly engaged in unauthorized military-style drills. Prosecutors argue that these actions contravened sections of the Penal Code Act concerning unlawful drilling and conspiracy.

Some of the accused are also facing robbery-related charges in a separate case before Masaka Chief Magistrates Court, where they are alleged to have robbed mourners and journalists of mobile phones and cash during a funeral last year. All accused have denied the charges, and multiple bail applications have been rejected by the courts.
