National Unity Platform (NUP) candidate Jackson Mbaju Kathika has petitioned the High Court seeking to overturn the victory of David Simbwa Milindwa of the NRM in the Busongora South Constituency parliamentary race, citing alleged electoral irregularities.
According to results announced by District Returning Officer Godfrey Byamukama on January 17, 2026, Milindwa narrowly defeated Mbaju with 10,845 votes against 10,760 votes.
However, Mbaju alleges that the results were manipulated in favour of his opponent. His legal team initially secured a court order for a vote recount, but the process was abruptly suspended after ballot boxes from three polling stations were found tampered with, raising concerns about the integrity of the election.
Chief Magistrate George Mufutindinda subsequently advised Mbaju to seek redress from the High Court. In a statement shared with URN, Mbaju said his team had obtained declaration of results (DR) forms from the Electoral Commission indicating that he was the rightful winner.
However, he noted that once the returning officer had declared results, the Electoral Commission could not alter them and instead advised him to pursue the matter in court.
Mbaju is now asking the High Court to nullify the declared results and instead declare him the duly elected Member of Parliament for Busongora South Constituency.
“It was found out that if the registrar/returning officer has declared the results, the electoral commission has no mandate to change what the registrar announced, and therefore they also advised us to go to court, and we have already served Mulindwa, the electoral commission, and the returning officer as respondents,” Mbaju said.
He added that he is now waiting for the court to set a hearing date for the petition. Mulindwa, however, maintains that his victory was legitimate and has called on Mbaju to drop the case and instead support his agenda for transforming the constituency. URN
